Terms of Use

Welcome to BOS Esports. These Terms of Use (“Terms”) govern your access to and use of the BOS Esports website at bosesports.com and all related services (collectively, the “Service”), operated by GoStar Digital LLC (“we,” “us,” or “our”), a company organized under the laws of the Commonwealth of Puerto Rico. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

1. Eligibility

You must be at least 13 years of age to use the Service. If you are under 18, you represent that you have your parent’s or legal guardian’s permission to use the Service. By creating an account, you represent and warrant that the information you provide is accurate and complete.

2. Account Registration

To access certain features of the Service, you must create an account by providing a gamertag (username), email address, and password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe have been compromised.

3. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service in any way that violates applicable laws or regulations
  • Attempt to gain unauthorized access to any part of the Service, other accounts, or any systems or networks connected to the Service
  • Use bots, scripts, automation tools, or any other means to artificially inflate scores, manipulate leaderboards, or gain unfair advantages
  • Interfere with or disrupt the Service or servers or networks connected to the Service
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity
  • Use the Service to harass, abuse, or harm another person
  • Reverse engineer, decompile, or disassemble any part of the Service

4. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, game designs, software, audio, and the BOS Esports brand — are the exclusive property of GoStar Digital LLC and are protected by copyright, trademark, and other intellectual property laws.

BOS Esports™, the BOS Esports logo, and all related marks are trademarks of GoStar Digital LLC. You may not use any of our trademarks without our prior written consent.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes, subject to these Terms.

5. User Content and Data

By using the Service, you acknowledge that your gamertag and game performance data (including scores, accuracy, reaction times, and tier progress) may be displayed publicly on leaderboards and aggregate statistics.

You retain ownership of any content you submit to the Service. However, by submitting content, you grant GoStar Digital LLC a worldwide, non-exclusive, royalty-free license to use, display, and distribute such content in connection with the Service.

6. Competitions and Events

BOS Esports may host or participate in gaming competitions, tournaments, and live events. Participation in such events may be subject to additional rules, which will be communicated to participants in advance.

We reserve the right to disqualify any participant who we reasonably believe has engaged in cheating, score manipulation, or any other violation of these Terms or event-specific rules.

7. Subscriptions and Payments

Certain features of the Service may require a paid subscription. If we offer paid plans, the pricing, features, and billing terms will be clearly presented at the time of purchase.

All payments are processed through third-party payment processors (e.g., Stripe). We do not store your full payment card information on our servers. By purchasing a subscription, you agree to the applicable payment terms and authorize recurring charges as described at the time of purchase.

Refund policies, if applicable, will be provided at the time of purchase or upon request.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We are not responsible for any damage to your computer system, device, or data resulting from your use of the Service.

BOS Esports provides neurocognitive training games designed to improve gaming performance. The Service is not a medical device and is not intended to diagnose, treat, cure, or prevent any medical condition.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GOSTAR DIGITAL LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless GoStar Digital LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause and with or without notice. Upon termination, your right to use the Service will immediately cease.

You may terminate your account at any time by contacting us. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, disclaimers, limitations of liability, and indemnification.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Puerto Rico, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the courts located in San Juan, Puerto Rico. You consent to the personal jurisdiction and venue of such courts.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Service and updating the “Effective Date” above. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GoStar Digital LLC regarding your use of the Service and supersede all prior agreements and understandings.
